Terms of Service

Plain-English summary: you subscribe to Dukky to automate employee and client gifting. You pay each reward's face value plus a 2% card fee (minimum $0.50). You are responsible for the people data you upload and for approving (or auto-approving) rewards. We are a small Australian company and this document keeps things fair for both of us.
1. Who we are
Dukky ("Dukky", "we", "us") provides software that automates milestone-based rewards for employees and clients. These terms are a binding agreement between Dukky and the entity that creates a workspace ("you"). By creating a workspace or using the service you accept these terms.
2. The service
Dukky detects milestones you configure (birthdays, anniversaries, onboarding dates, calendar dates), notifies your nominated approver by email, and on approval (or auto-approval, if you enable it) charges your stored payment method for the reward value and issues a digital reward the recipient can redeem for their choice of gift. We rely on third-party providers to deliver parts of the service, including Stripe (payments), Tremendous (reward fulfilment), Supabase (hosting and authentication), and Resend (email).
3. Subscriptions and billing
- Plans are billed in Australian dollars via Stripe, monthly or annually, with a 14-day free trial. A valid payment method is required to start a trial.
- You can cancel any time from Settings; cancellation takes effect at the end of the current billing period. We do not offer pro-rata refunds of subscription fees except where required by law, including the Australian Consumer Law.
- Prices may change with at least 30 days notice; changes apply from your next billing period.
4. Reward funding and fees
- When a reward is approved, we charge your stored payment method the reward value plus a 2% payment processing fee (minimum $0.50). The recipient always receives the full reward value; the fee is charged in addition to it and is never deducted from the gift.
- Unredeemed rewards expire 30 days after they are sent. Contact us for a refund of the reward value for expired, unredeemed rewards.
- If a charge fails, the reward is held and not issued until the charge succeeds.
5. Your responsibilities
- You confirm you are entitled to provide the recipient information you upload (names, email addresses, dates) and that doing so complies with applicable privacy law.
- You are responsible for reward decisions made in your workspace, including auto-approved rewards under settings you control, and for any tax obligations arising from rewards. Rewards may constitute taxable benefits; we provide a CSV export for your accountant, and nothing in the service is tax advice.
- You will not use the service for anything unlawful, for spam, or to send rewards to people who have not consented to be contacted by you.
6. Data
Your workspace data remains yours. We handle personal information as described in our Privacy Policy. You can request export or deletion of your workspace data at any time.
7. Availability and liability
We aim for high availability but the service is provided "as is" and we do not guarantee it will be uninterrupted or error-free. To the maximum extent permitted by law (and subject to any consumer guarantees under the Australian Consumer Law that cannot be excluded), our total liability for any claim arising out of the service is capped at the subscription fees you paid in the 12 months before the claim. We are not liable for indirect or consequential loss.
8. Termination
You may close your workspace at any time. We may suspend or terminate a workspace that breaches these terms, with notice where practicable. On termination we will make your data available for export for 30 days, then delete it.
9. General
These terms are governed by the laws of New South Wales, Australia. We may update these terms; material changes will be notified by email at least 14 days before they take effect. Questions: hello@dukky.co.
